Eligibility

You must be at least 18 years of age to use the Platform. If you are using the Platform on behalf of a minor in your legal care, you represent that you have the authority to do so. The Platform is available only to users located in the United States

Nature of Services

The Platform facilitates access to independent licensed healthcare providers for telehealth consultations. Humancare Connect, Inc. is not a medical practice or hospital and does not practice medicine. Healthcare services are provided by independent licensed physicians and providers who exercise their own professional judgment. We do not guarantee specific treatment outcomes. Telehealth services may not be appropriate for all medical conditions. In any emergency, call 911 or go to your nearest emergency room immediately — do not use this Platform for emergency care.

Account Registration

You agree to provide accurate, current, and complete information when registering for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Please notify us immediately if you suspect any unauthorized access to your account.

Appointments and Consultations

Scheduling an appointment does not guarantee a particular provider or a specific treatment outcome. Providers reserve the right to decline to prescribe or treat based on their independent clinical judgment. Consultations are conducted over secure video, telephone, or messaging, as offered on the Platform.

Prescriptions

Prescriptions are issued solely at the discretion of the licensed provider and only when clinically appropriate. We comply with all applicable federal and state laws regarding telehealth prescribing, including the Ryan Haight Online Pharmacy Consumer Protection Act. Certain controlled substances cannot be prescribed via telehealth under applicable law, and our providers are bound by those restrictions.

Fees and Payment

Fees for consultations and services are disclosed prior to booking. By booking an appointment, you authorize us to charge the applicable fee to your payment method on file. You are responsible for any copays, deductibles, or balances not covered by your insurer. Please review our Refund and Cancellation Policy for information on refunds and cancellations.

Prohibited Conduct

You agree not to provide false or misleading information about your identity or health history, attempt to obtain prescriptions through deception or misrepresentation, access or tamper with the Platform or its security measures, use the Platform for any unlawful purpose, or reproduce or distribute Platform content without our written permission.

Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Humancare Connect, Inc. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our express written permission.

Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, Humancare Connect, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform or services. Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Humancare Connect, Inc. and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or your use of the Platform.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute shall be resolved by binding arbitration in Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to a jury trial or participation in a class action.

Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform or by email. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
